Crops Description

Barley, wheat, corn, soybeans, sorghum, canola, potatoes, dried cassava, etc.

 

Prerequisite

Export access of plant-based products to China; Inspection and quarantine protocols signed and released by GACC.

 

Reminder

1. The Registration of Overseas Production, Processing and Storage Units of Imported Plant-Based Products applies to fresh fruit and grain products above. The registration method of primary produce does not vary with the implementation of GACC Decree 248 & 249.
2. In case of export of genetically-modified (GMO) corn, soybeans, canola, etc, the exporters must apply for Safety Certificate of GMO Produce from the Ministry of Agriculture and Rural Affairs of the People’s Republic of China. Each batch of GMO products must be attached with the corresponding certificate. Therefore, the GMO product, the developer’s bio-safety certificate, the exporter, the importer, use of the product, and the GMO processing and utilization units must be designated. Any change of use or illegal dumping are strictly prohibited.

Cooperation of GACC, Competent Authorities and Embassies

  • 01

    Registration recommendation. For production, processing and storage units of primary produce, the competent authority is required to submit a registration recommendation after the manufacturer passes an on-site inspection.

  • 02

    Inspection and assessment. As the recommendation reaches GACC, GACC reviews and verifies the application. If necessary, technical experts will be posted to the country/region of origin to evaluate the enterprise.

  • 03

    Registration and record filing. GACC will grant registrations to qualified units of production, processing, and storage. For substandard units, the application will be denied.

Application Materials:

  • 01

    Conditions of the located country/region: The relevant laws, regulations and standards of the country (region) in terms of animal and plant epidemics, veterinary hygiene, plant protection, pesticide and veterinary drug residues, registration management of production enterprises and hygiene requirements.

  • 02

    The institutional setting and personnel of the competent authority.

  • 03

    Information of the enterprise: enterprise name, address, and registration number.

  • 04

    Product information: product name, raw materials, usage etc.

  • 05

    The evaluation on the inspection, quarantine and sanitation control of the enterprise applying for GACC registration, for which the questionnaire is provided by GACC and completed by the competent authority.

Work Flow

  • 01

    Confirmation of the HS code and registration method of the product to be registered.

  • 02

    Inspection of the production, processing and storage units of plant-based products, conducted by the competent authority. The enterprise applying for registration must submit all required documents for review of the competent authority, and file for record accordingly.

  • 03

    Submission of the application materials to the embassy in China.

  • 04

    GACC inspection: evaluation and review by technical professionals, including but not limited to document review, video inspection, and on-site audit.

  • 05

    Inspection result: the approval or disapproval of a registration will be communicated to teh embassy.

  • 06

    Public release of approved registrations online.

5. Supplementation and correction of materials. If the documents do not meet the registration requirements, we will work with enterprises on the interpretation, organizing, screening, editing, translation, and calibration of the required materials, along with the compliance action within the time frame.

6. Communication and follow-up with the GACC inspection and review team. Preparation and guidance of video and on-site inspection for the enterprise.

7. The acquisition of GACC registration, and follow-up support on the registration data for customs clearance.

8. Consultations for GACC compliance.

Common Mistakes

1. False classification of the product, leading to the false choice of procedure.

2. Failure to complete self inspection of the enterprise in accordance with the checklist of GACC.

3. Providing documents in neither Chinese nor English.

4. Missing seal or signature of the competent official.

5. Lack of required information in the application form.

6. Inconsistency or contradictions of the attachments and information provided by the enterprise.

7. Descriptions and signs of non-compliance with Chinese laws and regulations.

8. For first-time imports to China: lack of the conformity assessment of the regulatory system, officially issued in the country of origin.

Case: the application of market access for genetically modified canola (GMO) manufacturer in Canada.

1. Application filed to Agriculture and Agri-Food Canada by manufacturer

2. Application filed to GACC via the embassy of Canada in Beijing, China.

3. Submission of the Bio-Safety Certificate, lab analysis and research reports, for acquisition of Safety Certificate of GMO Agricultural Imports.

4. For each batch of imports, a Safety Certificate of GMO Agricultural Imports MUST be attached for custom declaration.
