GACC registration process (text description)

(1) Application, acceptance, evaluation, review and decision of registration

1. Application

The application methods for an overseas production enterprise of imported food for registration, modification, continuation, and cancellation include recommendation by the competent authority of the country (region) where it is located and enterprise self-application.

18 products (including meat and meat products, casings, aquatic products, dairy products, bird's nest and bird's nest products, bee products, eggs and egg products, edible fats and oils, stuffed pasta, edible cereals, cereal milling industrial products and malt, preserved and dehydrated vegetables, dried beans, seasonings, nuts and seeds, dried fruits, unroasted coffee beans and cocoa beans, special dietary foods and health food should be conducted by the competent authority of the country (region) where they are located. After reviewing and checking and confirming that the registration requirements are met, the competent authority of the country/region shall examine and inspect the manufacturer to be recommended for registration; after confirming that the manufacturer conforms with the registration requirements, the competent authority of the country/region recommends the producer to the GACC for registration.

Overseas manufacturers of foods other than those listed 18 kinds shall file applications for registration by themselves or by agents to the GACC.

2. Submit

Unless otherwise agreed by the competent authority of the relevant country (region) and the General Administration of Chinese Customs on the application method and application materials, the application for the registration, modification, renewal and cancellation of the overseas production enterprise of imported food shall be submitted through the registration management system of the overseas production enterprise of imported food.

3. Acceptance

After receiving the application materials, the Food Bureau of the General Administration of Chinese Customs will deal with them according to the following circumstances:

(1) If the materials meet the requirements, it will be accepted;

(2) If the materials do not conform to the legal form or are incomplete, within 20 working days from the date of receipt of the application materials, the competent authorities of the country (region) where they are located or the overseas production enterprises of imported food should be notified at one time of all the contents to be supplemented and corrected;

(3) If the registration management is not required by the "Regulations of the People's Republic of China on the Administration of Registration of Overseas Production Enterprises of Imported Food", it will not be accepted and notified to the competent authority of the country (region) or the overseas production enterprise of imported food;

(4) If an overseas enterprise applying for registration is found to provide false materials, it will not be accepted and inform the competent authorities of the country (region) where it is located or the overseas manufacturer of imported food; The relevant requirements of Article 24 of the Regulations on the Registration and Administration of Overseas Production Enterprises (Order No. 248 of the General Administration of Customs) shall be handled.

The Food Bureau of the General Administration of Chinese Customs can provide feedback on the acceptance status to the competent authorities of the country (region) or the overseas manufacturer of imported food through written letters, fax documents, emails or information systems.

4. Evaluation

According to risk analysis and actual work needs, the Food Bureau of the General Administration of Chinese Customs may organize an evaluation team to conduct evaluation and review of the overseas production enterprises of imported food that apply for registration through written inspections, video inspections, on-site inspections and their combinations. The form of assessment and review for overseas production enterprises of imported food is as follows:

1. Written inspection: The General Administration of Chinese Customs organizes an evaluation team to inspect the application documents submitted by the competent authorities of the country (region) or overseas production enterprises by reviewing the submitted application documents. According to the application documents and materials, the General Administration of Customs may request the competent authorities of the applicant country (region) or overseas production enterprises to supplement the missing information or materials.

2.Video inspection: The General Administration of Chinese Customs organizes an evaluation team to inspect the enterprise's food safety and hygiene management system and its food safety and hygiene status through Internet video connection. Enterprises that accept video inspections and the competent authorities of the countries (regions) where they are located shall provide necessary assistance for video inspections. For the relevant problems found in the video inspection, the General Administration of Customs may request the enterprises that accept the video inspection and the competent authorities of the country (region) where they are located to make rectification and submit the corresponding rectification information.

3. On-site inspection: The General Administration of Customs organizes an evaluation team to go overseas to the on-site site of the overseas production enterprise applying for registration to conduct inspection and verification of the enterprise's food safety and hygiene management system and its food safety and hygiene status. The enterprises that accept the on-site inspection and the competent authorities of the country (region) where they are located shall provide necessary assistance for the on-site inspection. For the relevant problems found in the on-site inspection, the General Administration of Customs may require the enterprises under the on-site inspection and the competent authorities of the country (region) where they are located to make rectification and submit the corresponding rectification information.

The content and standards of the evaluation and review will be based on the relevant guidelines of the three sister organizations of the World Trade Organization (WTO) (OIE, IPPC, CAC), the relevant inspection and quarantine requirements agreed by the General Administration of Customs and the competent authorities of the country (region) where they are located, relevant Chinese laws and regulations and Implementation of national food safety standards.

The Food Bureau of the General Administration of Customs will organize the review team to carry out video inspections and on-site inspections, and will communicate and negotiate in advance with the competent authorities of the country (region) where the enterprise is located in accordance with risk analysis and international practices.

6. Decision of registration

According to the evaluation and review, the General Administration of Customs will register the overseas production enterprises of imported food that meet the requirements and give them a registration number in China, and notify the competent authorities of the country (region) or the overseas production enterprise of imported food; The enterprise shall not be registered, and shall notify the competent authority of the country (region) where it is located or the overseas manufacturer of imported food.

The Food Bureau of the General Administration of Customs may notify the competent authority of the country (region) where it is located or the overseas manufacturer of imported food through written letters, fax documents, emails or information systems.

(2) Changes in registration

When the registration items of a registered overseas enterprise are changed, the competent authority of the country (region) where it is located or the overseas production enterprise of imported food shall submit the corresponding change application materials according to the application channels and requirements.

After evaluation and review, if it is believed that the change does not involve the food safety and hygiene management control of overseas enterprises (such as the change of company name, etc.), and it is confirmed that it meets the change requirements, the change shall be made; after evaluation and review, if it is believed that the relevant changes and adjustments may affect the food safety and hygiene of overseas enterprises If it is under management control, it will not be changed, and the competent authority of the country (region) where it is located or the overseas manufacturer of imported food will be notified to submit a new registration application according to the application route. After the new registration application is approved, the original registration number in China will automatically become invalid, and the registration qualification will be cancelled.

A new registration application should be submitted for the relocation of the production site, the change of the legal representative, or the change of the registration number granted by the country (region) where the company is located. After the new registration application is approved, the original registration number in China will automatically become invalid, and the registration qualification will be cancelled.

The relocation of the production site refers to the actual production site (factory area) of the food exported from China. The change of the office of the management personnel does not belong to the relocation of the production site. The change of the legal representative refers to the change of the actual owner of the overseas enterprise. If the actual owner of the overseas enterprise remains unchanged, but the personnel who manage the production site (factory) of the enterprise on behalf of the actual owner change, the production enterprise may apply for the change first, and the General Administration of Customs will evaluate the actual effect of the corresponding change on the management and control of the enterprise’s food safety and hygiene. impact and decide whether to change it.

(3) Renewal of registration

For a registered overseas enterprise, 3 to 6 months before the expiration of the registration period, the competent authority of the country (region) where it is located or the overseas production enterprise of imported food should submit the corresponding application materials for registration renewal according to the application channels and requirements.

After evaluation and review, if it is confirmed that the renewal registration requirements are met, the registration will be renewed; if the requirements are not met, the renewal will not be granted and a written notification to the competent authority of the country (region) or the overseas manufacturer of imported food will be issued, and the original registration number in China will expire. It will automatically expire and the registration qualification will be cancelled.

The Food Bureau of the General Administration of Customs may notify the competent authority of the country (region) where it is located or the overseas manufacturer of imported food through written letters, fax documents, emails or information systems.

(4) Cancellation Registration

When a registered overseas production enterprise of imported food applies for cancellation of its qualification, the competent authority of the country (region) where it is located or the overseas production enterprise of imported food shall submit the corresponding cancellation application materials according to the application channels and requirements.

The Food Bureau of the General Administration of Chinese Customs will cancel those that meet the cancellation requirements, notify the competent authorities of the country (region) where they are located or the overseas production enterprises of imported food, and make an announcement.
