Regarding the Inspection and Quarantine Requirements for Export of Wild Aquatic Products from Romania
In accordance with the regulations regarding inspection and quarantine requirements for wild aquatic products exported to China, as established by the General Administration of Customs of China (GACC) and the National Sanitary Veterinary and Food Safety Authority of Romania, effective immediately, the importation of wild aquatic products from Romania that meet the following relevant requirements is permitted:
I. Basis for Inspection and Quarantine
(1) The *Food Safety Law of the People's Republic of China* and its Implementing Regulations; the *Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine* and its Implementing Regulations; and the *Law of the People's Republic of China on Import and Export Commodity Inspection* and its Implementing Regulations.
(2) The *Administrative Measures of the People's Republic of China for the Safety of Import and Export Food* and the *Administrative Provisions of the People's Republic of China on Registration of Overseas Manufacturers of Imported Food*.
(3) The *Protocol between the General Administration of Customs of the People's Republic of China and the National Sanitary Veterinary and Food Safety Authority of Romania on Inspection and Quarantine Requirements for Wild Aquatic Products Exported to China*.
II. Scope of Import Products
"Wild aquatic products" refers to wild aquatic animal products and their derivatives intended for human consumption, as well as marine plant products (such as algae) and their derivatives. This category excludes amphibians, reptiles, aquatic mammals, live aquatic animals, and aquatic animal or plant reproductive materials.
III. Requirements for Production Enterprises
Enterprises producing wild aquatic products for export to China (including production, processing, and storage facilities) must be approved by the National Sanitary Veterinary and Food Safety Authority of Romania and be subject to its effective supervision. The food safety, hygiene management, and protection systems of these production enterprises must comply with the requirements of relevant Chinese laws and regulations concerning food safety.
In accordance with the *Food Safety Law of the People's Republic of China* and its Implementing Regulations, as well as the *Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine* and its Implementing Regulations, enterprises producing wild aquatic products for export to China must be recommended for registration with the GACC by the National Sanitary Veterinary and Food Safety Authority of Romania. Exports to China are prohibited unless such registration has been obtained.
The National Sanitary Veterinary and Food Safety Authority of Romania may recommend lists of production enterprises applying for registration in China to the GACC via a "list-based registration" method, submitting the accompanying registration application materials in accordance with relevant regulations. Enterprises included in the list that are found to meet the requirements upon review shall be granted registration; those that do not meet the requirements shall be denied registration.
IV. Requirements for Imported Products
The National Sanitary Veterinary and Food Safety Authority of Romania shall ensure that wild aquatic products intended for export to China meet the following conditions:
(I) They have been legally harvested in domestic or international waters.
(II) Neither the raw materials nor the finished products shall be subject to any of the following circumstances:
1. Wild aquatic products from Romania—whether already exported to China or intended for export—are found to be in violation of relevant Chinese laws, regulations, and national standards regarding food safety, or the provisions of this *Protocol*, thereby having a serious impact on the safety of wild aquatic products exported to China.
2. Outbreaks occur within Romania of aquatic animal diseases—listed in the *List of Diseases Subject to Entry Animal Quarantine of the People's Republic of China* or designated as notifiable by the World Organisation for Animal Health (WOAH)—that are relevant to the products covered by this *Protocol*, thereby having a serious impact on the safety of wild aquatic products exported to China.
3. Major food safety incidents occur within Romania; or major public health incidents occur within the production enterprises; or the harvesting waters are affected by contaminants; any of which have a serious impact on the safety of wild aquatic products exported to China.
(III) They do not directly or indirectly contain drugs or additives prohibited in China, and any drugs or additives used are limited or permitted in China by the General Administration of Customs, in accordance with relevant regulations.
(IV) Upon inspection and quarantine by the competent authorities, they are found to be free of pathogenic microorganisms, toxic and harmful substances, and foreign matter as specified in Chinese laws and regulations; and are found to be free of aquatic animal diseases listed in the aforementioned *List* or designated as notifiable by the WOAH.
(V) The entire production process—including harvesting, processing, packaging, storage, transportation, transit, and export—shall comply with relevant Chinese requirements regarding safety, hygiene, and traceability.
(VI) The packaging and labeling of the products shall comply with China's national standards for food safety and relevant regulations governing the safety management of imported food.
V. Certificate Requirements
The National Sanitary Veterinary and Food Safety Authority of Romania shall conduct inspection and quarantine on wild aquatic products intended for export to China in accordance with the requirements of China Customs. Furthermore, for each consignment of wild aquatic products exported to China, the Authority shall issue a sanitary certificate—mutually agreed upon by both parties—attesting that the products in said consignment comply with the relevant provisions of China's laws and regulations concerning food safety. The certificate shall be printed in at least Chinese and English; when completing the certificate, English shall be a mandatory language.
The sanitary certificate shall be fully completed with the details of the production establishment exporting the wild aquatic products to China. The National Sanitary Veterinary and Food Safety Authority of Romania shall promptly submit specimens of the certificate and its official seal to China Customs for filing. In the event of any changes, the National Sanitary Veterinary and Food Safety Authority of Romania shall notify China Customs for filing at least one month prior to the effective date of such changes.
VI. Other Requirements
China Customs shall conduct inspection and quarantine on wild aquatic products exported to China in accordance with China's relevant laws and regulations on food safety, national standards, and the provisions of the *Protocol*.
Non-compliant products shall be subject to destruction, return shipment, or other appropriate disposal measures. In cases involving serious issues, or where non-compliance issues occur repeatedly, China Customs may implement measures such as intensified inspection and quarantine or the suspension of imports from the production establishment in question.
