Regarding the Inspection and Quarantine Requirements for Rice Bran and Rice Bran Solvent from Vietnam to China

According to relevant Chinese laws and regulations and the "Protocol on Sanitary and Phytosanitary Requirements for the Export of Rice Bran and Rice Bran Solvent from Vietnam to China between China Customs and the Ministry of Agriculture and Environment of Vietnam", the import of Vietnamese Rice Bran and Rice Bran Solvent that meet the following relevant requirements is allowed:

 

I. Inspection and quarantine basis

(I) "Biosafety Law of the People's Republic of China";

(II) "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations;

(III) "Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Feed and Feed Additives";

(IV) "Protocol on Sanitary and Phytosanitary Requirements for the Export of Rice Bran and Rice Bran Solvent from Vietnam to China between China Customs and the Ministry of Agriculture and Environment of Vietnam".

 

II. Names of commodities allowed to enter the country

Rice Bran in this announcement refers to the feed by-product after refining rice with brown rice as raw material; Rice Bran Solvent refers to the feed by-product after oil is extracted from Rice Bran by leaching or pre-pressing leaching.

 

III. Enterprise Registration

Rice Bran and Rice Bran Solvent exported to China shall come from production, processing and storage enterprises approved by the Ministry of Agriculture and Environment of Vietnam. The relevant enterprises shall have the ability to detect safety and sanitation items such as total mold count, salmonella, heavy metals, etc. The enterprises shall be recommended by the Ministry of Agriculture and Environment of Vietnam to the Chinese Customs, and shall be registered after review and approval by the Chinese Customs, and shall be published and updated on the website of the Chinese Customs.

 

IV. Pests of Concern

Rice Bran and Rice Bran Solvent exported to China shall not carry the following pests:

1. Trogoderma granarium

2. Xanthomonas oryzae pv. oryzae

3. Xanthomonas oryzae pv. oryzicola

4. Burkholderia glumae

5. Ditylenchus angustus

6. Striga spp.

7. Eupatorium odoratum

8. Cenchrus spp.

9. Sorghum halepense

 

V. Requirements before shipment

(I) Production requirements

1. The Ministry of Agriculture and Environment of Vietnam should require enterprises to establish a good Hazard Analysis and Critical Control Point (HACCP) system and an effective traceability management system.

2. The Ministry of Agriculture and Environment of Vietnam should require enterprises to strengthen the sanitary control of raw materials, production and processing, warehousing, transportation and other links to avoid contamination by soil, animal carcasses, animal feces and feathers, and shall not add toxic and harmful substances and any animal-derived ingredients, and the production line shall not be used to produce animal-derived feed.

3. The Ministry of Agriculture and Environment of Vietnam should strengthen official control and supervision over enterprises, and conduct official compliance sampling and testing of each company's Rice Bran and Rice Bran Solvent finished products exported to China at least once every three months to ensure that the products meet the relevant safety and hygiene standards of Chinese feed. Once unqualified products are detected, the Ministry of Agriculture and Environment of Vietnam will immediately suspend the relevant enterprises from exporting to China and notify the Chinese Customs to find out the reasons and take improvement measures.

4. The Ministry of Agriculture and Environment of Vietnam should require enterprises to formulate self-inspection and self-control plans for the safety and health indicators of Rice Bran and Rice Bran Solvent exported to China, isolate the production area and storage area, ensure that Rice Bran and Rice Bran Solvent exported to China are stored separately, and take effective measures to prevent rats, insects and birds to prevent contamination.

(II) Packaging and transportation requirements.

1. The Ministry of Agriculture and Environment of Vietnam should ensure that the packaging bags used for Rice Bran and Rice Bran Solvent exported to China are clean and hygienic, and the means of transportation should be thoroughly cleaned and disinfected when necessary according to the weather and usage conditions.

2. There should be at least one packaging mark in the container or ship's cabin (such as bulk shipping) loaded with Rice Bran and Rice Bran Solvent exported to China, indicating the company name and registration number in China, and the Chinese and English words "越南米糠输往中华人民共和国"(Vietnam rice bran exported to the People's Republic of China) or "越南米糠粕输往中华人民共和国"(Vietnam rice bran solvent exported to the People's Republic of China).

3. The product labels of Rice Bran and Rice Bran Solvent exported to China shall comply with the requirements of China's national standard "Feed Label" (GB10648).

(III) Pre-export inspection and quarantine and certificate requirements.

1. Rice Bran and Rice Bran Solvent that have passed inspection and quarantine are allowed to be exported to China.

2. The Ministry of Agriculture and Environment of Vietnam shall issue a phytosanitary certificate in accordance with the requirements of the International Standard for Phytosanitary Measures No. 12 "Guidelines for Phytosanitary Certificates". The additional statement of the phytosanitary certificate shall indicate "This consignment meets the requirements of the Protocol on Sanitary and Phytosanitary Requirements for the Export of Rice Bran and Rice Bran Solvent from Vietnam to China, and does not carry any quarantine pests or toxic and harmful substance of concern to China", and the company name and registration number in China, container (carriage) number or ship name (for bulk shipping) and other information; if it has been effectively treated for pests before export or during transportation, the pest control treatment method and treatment indicators and other information shall be indicated in the certificate.

3. Each batch of Rice Bran and Rice Bran Solvent exported to China shall be accompanied by a safety and health declaration issued by the Ministry of Agriculture and Environment of Vietnam.

 

VI. Entry Inspection and Quarantine

(I) Document Verification.

1. Verify whether it comes from a registered enterprise;

2. Verify whether the plant quarantine certificate is authentic and valid.

(II) Cargo Inspection.

In accordance with relevant laws, administrative regulations, rules, etc., combined with Articles 4 and 5 of this Announcement, Rice Bran and Rice Bran Solvent will be subject to inspection and quarantine, and will be allowed to enter the country after passing the inspection.

(III) Handling of non-compliance situations.

1. If there is no valid plant quarantine certificate or safety and health declaration, it shall be returned or destroyed;

2. If live quarantine pests or other pests of concern to China Customs are found, they shall be treated with pest control, returned or destroyed;

3. If soil or genetically modified ingredients not approved by the Chinese government are found, they shall be returned or destroyed;

4. If animal carcasses, animal excrement or other prohibited items are found, they shall be treated with pest control, returned or destroyed in accordance with relevant laws and regulations;

5. If it is found that the safety and health items do not meet the requirements of China's feed safety and health standards, they shall be treated with pest control, returned or destroyed;

6. If it is found that it does not meet the requirements of Article 5, paragraph (2), item 3, it shall be corrected, returned or destroyed.

If the above non-compliance is found, China Customs will notify the Ministry of Agriculture and Environment of Vietnam and take measures such as suspending the qualifications of relevant enterprises according to the severity.
