Regarding the Inspection and Quarantine Requirements for Dairy Products from HongKong to Chinese Mainland
According to the provisions of the General Administration of Customs and the Environment and Ecology Bureau of the Government of the Hong Kong Special Administrative Region on the inspection, quarantine and sanitation requirements for dairy products exported from Hong Kong to the Mainland, from the date of this announcement, dairy products from Hong Kong that meet the following requirements are allowed to be exported to the Mainland:
I. Inspection and quarantine basis
(I) "Food Safety Law of the People's Republic of China" and its implementing regulations, "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations, "Import and Export Commodity Inspection Law of the People's Republic of China" and its implementing regulations;
(II) "Cooperation Arrangement between the General Administration of Customs and the Environment and Ecology Bureau of the Government of the Hong Kong Special Administrative Region on Dairy Products Exported from Hong Kong to the Mainland".
II. Products allowed to be exported to the Mainland
Dairy products exported to the Mainland refer to various types of dairy products processed with cow's milk as the main raw material and meet the requirements of national food safety standards.
III. Requirements for production enterprises
Dairy production enterprises exported to the Mainland must be approved or registered by the Food and Environmental Hygiene Department of Hong Kong and continue to comply with the relevant laws, regulations and standards of food safety in the Mainland under the supervision of the Food and Environmental Hygiene Department of Hong Kong.
According to the "Food Safety Law of the People's Republic of China", production enterprises of dairy products exported to the Mainland shall be registered with the General Administration of Customs, and products produced by unregistered enterprises shall not be exported to the Mainland.
IV. Certificate requirements
Dairy products exported to the mainland should be accompanied by a health certificate issued by the Food and Environmental Hygiene Department of Hong Kong. Each batch of goods should be accompanied by the original to prove that the batch of products complies with relevant regulations. The certificate should state but not be limited to the following:
(i) The product comes from a production enterprise holding a valid license issued by the Food and Environmental Hygiene Department of Hong Kong;
(ii) The product comes from a production enterprise registered with the General Administration of Customs, and the enterprise registration number is marked in the certificate;
(iii) The raw milk used in the product is all from mainland dairy enterprises and has passed inspection and quarantine;
(iv) The residues of veterinary drugs, pesticides, pollutants, food additives and other toxic and harmful substances in the product do not exceed the maximum limit stipulated by the mainland. The product is not contaminated by pathogenic microorganisms and meets the requirements of mainland laws;
(v) The product is suitable for human consumption.
Official seal impressions, certificate samples, list of authorized visa officers, anti-counterfeiting label instructions, etc. are provided. If there are any changes or modifications to the above content, the General Administration of Customs should be notified one month in advance.
V. Food Safety Requirements
(i) Dairy products exported to the Mainland shall comply with the relevant laws, regulations and standards of the Mainland for food safety, be safe, hygienic and suitable for human consumption;
(ii) All raw milk raw materials for dairy products exported to the Mainland shall come from dairy enterprises in the Mainland and have passed inspection and quarantine;
(iii) According to the test results of raw milk, the residues of veterinary drugs, pesticides and other toxic and harmful substances in the raw milk used shall not exceed the maximum limits specified by the Mainland standards;
(iv) Raw milk used to process dairy products does not contain spoiled milk and colostrum (except when used to process bovine colostrum powder);
(v) Colostrum ingredients are not added to milk-based infant formula;
(vi) Dairy products exported to the Mainland shall be stored in a dedicated area of the warehouse and clearly marked.
VI. Packaging and Labeling Requirements
The labels and markings of dairy products exported to the Mainland shall comply with relevant laws, regulations and national food safety standards of the Mainland.
VII. Storage and Transportation Requirements
Dairy products exported to the Mainland shall be kept hygienic throughout the entire process from packaging, storage to transportation to prevent contamination by pathogenic microorganisms and toxic and harmful substances. Storage and transportation should be carried out under the temperature conditions required by the corresponding products. After the goods are loaded into the carriage or container, the Hong Kong Food and Environmental Hygiene Department supervises the random inspection and applies the seal. The packaging shall not be opened or replaced during transportation.
